Terms of Service
Effective date: [DD MONTH 2026]
1. Who we are & acceptance
Yasenza is operated by [LEGAL ENTITY — e.g. Yasenza (Pty) Ltd] (registration no. [COMPANY REGISTRATION NUMBER]), [REGISTERED ADDRESS, South Africa] (“Yasenza”, “we”, “us”). By creating an account or using the service you (the organization and each of its authorized users) agree to these Terms, our Privacy Policy and our Acceptable Use Policy. If you do not agree, do not use Yasenza.
2. The service
Yasenza is a tool for scheduling and automatically publishing messages and media to WhatsApp groups that your organization controls, with multi-user roles, an audit trail, delivery logs and retry handling. You are responsible for the content you schedule and for ensuring you are entitled to post it to the relevant groups.
3. Important — how Yasenza connects to WhatsApp (read carefully)
Yasenza sends messages using the WhatsApp Web protocol via an open-source library. You should understand and accept the following:
- Yasenza is not affiliated with, endorsed by, or sponsored by WhatsApp LLC or Meta Platforms, Inc. “WhatsApp” is a trademark of its owner.
- Automated use of WhatsApp may be contrary to WhatsApp’s own terms. WhatsApp may, at its discretion, rate-limit, suspend, or permanently ban a number. This risk can be reduced but never eliminated.
- You supply and own the WhatsApp number linked to your account (a dedicated number is strongly recommended). One number is linked to exactly one Yasenza account. A ban or block affects your number, not the platform.
- We are not responsible for any loss of access to WhatsApp, loss of a number, or non-delivery caused by WhatsApp/Meta, network conditions, or your own usage. Use Yasenza only for legitimate communication with your own communities — see the Acceptable Use Policy.
4. Your account & responsibilities
- You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
- You must have the necessary authority and consents to message the recipients and groups you target.
- Administrators are responsible for the users they invite and the permissions they grant.
- You must comply with the Acceptable Use Policy and all applicable laws, including data-protection law (POPIA).
5. Subscriptions, billing & trials
- Paid plans are billed in advance on a recurring basis via our payment processor (Paystack). Prices are shown exclusive of VAT unless stated otherwise.
- Any free trial converts to a paid plan only if you choose to subscribe; we will make the terms of a trial clear before it starts.
- You may cancel at any time; cancellation stops future renewals. Except where required by law, fees already paid are non-refundable, and plan limits apply immediately on downgrade.
- We may change pricing on reasonable notice; changes apply from your next billing cycle.
6. Availability & “as is”
We work to keep Yasenza reliable but do not guarantee uninterrupted or error-free service. The service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. This does not exclude any rights you have under the Consumer Protection Act or other law that cannot lawfully be excluded.
7. Limitation of liability
To the maximum extent permitted by law, Yasenza and [LEGAL ENTITY — e.g. Yasenza (Pty) Ltd] are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, data, goodwill, or business, arising from your use of (or inability to use) the service — including any WhatsApp ban, suspension, or non-delivery. Our total aggregate liability for any claim is limited to the fees you paid to us in the three (3) months before the event giving rise to the claim.
8. Suspension & termination
We may suspend or terminate access for breach of these Terms or the Acceptable Use Policy, for non-payment, or where required to protect the platform or other customers (for example, abusive or spam-shaped usage). You may stop using Yasenza and close your account at any time. You may export your data before closing; after closure we handle residual data per the Privacy Policy.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use after changes take effect means you accept them.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa, and the parties submit to the jurisdiction of the [High Court of South Africa, Gauteng Division].
